We are starting an eviction process for non-payment. She is a single mother, but is living in a one room appartment with 3 kids! supposely she was going to live by herself. Anyway, I would like to know if any of you had to go thru this and how long does it normally take?

You obviously have grounds to evict her for non-payment, fraud, breach of contract, etc. You need to contact a lawyer, and not rely on Yahoo Answers.

Regardless, have you asked her to pay or leave in writing? If not, then you can't start an eviction. Some states' laws may prevent you from turning off the utilities, so don't think about that. Also, CT law prohibits you from locking her out. It's understandable, yet, at the same time unfortunate, because, as with most laws, it protects the guilty at the expense of the innocent. Bad tenants rely on such inane laws to provide them with, essentially, free shelter. Even if they lose in court (which the bad tenant knows will cost the landlord a pretty penny, even if it's small claims court), good luck in getting them physically off the premises; you'll need to call a Sheriff, Marshall, or similar for that. On the other hand, the bad tenant may not know the law, and you can "test" them by threatening to lock them out or call the police. That alone may scare her out (but, then you might face a wrongful action suit; isn't our justice system wonderful?).

Here's a link that is very informational.

Depends on your state laws. If you have never done this, you better have a lawyer, and have the lawyer show you how to do this. I am in Illinois and it takes up to 3 months to physically get them out of the place.
