I workED for a small company where there were two owners and two other people icluding me in a small office, no cubicles, just open desks. One owner was, cool & funny, the other was always stressed and always talking down on us and treating us very poorly. I talked to the other person in the office about how she felt about Keith and she says they've had this talk with him before and he's very one sided so when I talk to him about it to have Tuan in the room. I asked the "cool" owner if we could discuss it with him the next day and he agrees. Next day we go in the office, I am more than professional and reasonable. I tell him I am uncomfortable with the way he treats Kiana and I. He spends 30 minutes telling me to "deal with it." We get absolutely no where and I am STUNNED at our conversation. I just sat there with my jaw dropped, it was so crazy. This morning, I'm called into the office and told that they have to let me go because My & Keith's "personalities clash." Is this legal?

Who can I talk to? Where do I go? What can I do about it and is it worth it? Anyone in California gone through this?

Most states operate under the "employee at will" policy. You can be fired at any time for any reason EXCEPT for reasons regarding discriminating reasons like race, religion, etc.

If you were let go because your personalities "clashed" that is a perfectly legal reason to let you go and legally they have done nothing wrong. Well, morally it was wrong but legally you have no claim against them.

Of course it's legal.

Do you really think you have more rights in a company than the owners? It may seem that way at times, but it isn't.

A person who quits work or is fired from work will be scheduled to a telephone interview because there is a separation issue that must be resolved. The Department interviewer obtains and documents information about the separation from the employer and claimant and decides, according to law and regulations, if the person is eligible to collect benefits.

It seems like there is nothing illegal in this case. Personalities and personality conflicts are always more complex than the law. Plus, it's a small business. They normally can do what they want, as long as it is within legal parameters of handling sex, race, religion issues.

You could talk to an employment lawyer, but he/she will probably tell you the same thing.

Depends how long you worked there. Either way, you are eligible for unemployment, so go file for it immediately. Then, you should ask for an official letter stating the reason you were fired and contact the local labor board (it's free for you) and see if they have any advice.

P.S. In the future, make your questions shorter and easier to read. This whole thing could have been summed up with "I talked to my boss about a difficult coworker, and I was the one fired because our "personalities" clash. Is this legal?"

Yes, it's legal. The only illegal reasons are those based on protected class. Race, Sex, Age, Disability, etc. They are no laws against being a jerk.

You are an "at will employee"

You can leave at any time.
Your employer can dismiss you at any time.

File for unemployment.
