On a 2004 nissan maxima. The car acts like it's dead and when i try it 2 minutes later, it starts. It does this in the morning and at work. I'm thinking the starter. What do you guys think?

It could be a shorted ignition switch delay issue: you switch it "ON" and some delay (much like those for winshield wipers) goes into play seconds later.

If you haven't checked your car's fusebox, I'd start there and find the one(s) controlling ignition. Clear that, look at the ignition wiring connections. Clear that, follow into starter issues.

When it comes to a car's electrical problems, it's simply best to let mechanics who know Nissans handle the repairs.
