or for that matter any kind of lawsuit..can u accept the settlement amount without going to court...or can my lawyer pursue it further?...does a the settlement amount necasarilly mean its the final amount in the case? regardign a car accident case.

oh ok... the case is good..it was a car hitting a pedestrain....and the person has been out of work for 2 years.

You CAN accept the settlement without going to court OR your lawyer can pursue the case. If you accept a settlement, that MAKES it the final amount in the case. There is no way to know for certain if you could get more, but your lawyer should be able to make a good guess.

it depends on the state you live in.

some have no fault laws, in which case your insurance company pays no matter whose fault it is.

in other states, there as to be a finding of liability.

insurance companies offer money in the hope that you will take it and not drag them into court. they know that you can't afford to pay a lawyer, so they lowball the settlement. on the other hand, if you go to court, you run the risk of losing.
