I moved in to my aparment in July, upon moving in the landlord knew that the former occupants trashed the place and there was a massive amount of cockroaches. When we inspected the apartment, we were told that the cabnents would get fixed, the carpet would be replaced, and they would finish cleaning, repair the air conditioner, and toliet We had no ideas about the roaches.

Well the day we moved in, I opened the cabinet and four roaches crawlled out, and fell to the counter,. then upon walking around i counted about 13 more roaches. I called the aparment complex and they sent out another person to spray the aparment, even though they just did it 5 days ago. Then I found out that she was hoping that the roaches were dead, and that there was tons in there the day before.

It is now september, and we just had our apartment sprayed for the 4th time, the carpet, cabinets, are still not fixed, there is a soft spot now on the floor due to the toliet being broken. is this enough?

Send your landlord a letter detailing all the problems that still have not been repaired. Offer to have them fixed and deduct the cost from the rent.

You might want to hint that the conditions violated housing codes and an inspector would surely find many other things wrong with the place.

Word the letter just right, and your landlord will have all those repairs taken care of real quick.

No, it isn't enought to break the lease. You need to set up a paper trail of repeated requests for repairs that haven't been taken care of. If the letter fails, call your local housing inspector and turn them loose in your place.

Well it sounds like your landlord has a money pit going for an apartment that he/she does not want to mess with anymore than they have too. Yes, I belive you have a strong case. You need to make sure you are documenting somehow all the calls you have made for extermination of the apartment.

Also, if they are willing to be recorded (as long as you let them know they are being recorded) as saying to replace everything then your case could be very strong or you have documentation. All courts need documentation. Because I garauntee they will try to take you to court for breaking your lease. Even though you have every right to under those conditions.

If it isn't, then nothing will do it. Contact the local housing authority or city inspectors or whoever is in charge of such things in your area. They should be able to either tell you how to go about getting out of this mess or tell your landlord to get it in gear and fix everything.

Welcome to the apartment life, sweetie. That's the way it will be in most complexes that you move in to. They take their sweet *** time doing maintenance for your apartment, but as soon as you're but a day late on your rent, they're knocking on your door. Now, in this case I do believe you have enough evidence to break your lease. If you don't wanna leave, talk to the landlord and tell him/her upfront that YOU WILL LEAVE IF THE MAINTENANCE THAT HE/SHE PROMISED ISN'T PERFORMED. If you still don't get results, then get out.

Evidence, lots of it. Pictures. Write down every scratch on your checklist, if you don't, they'll try to blame you for it.
