They are birds. All birds are bipedal (two legs) with wings, which is a pretty much dead give away.

A penguin is a bird. It has feathers, lays eggs, and has a beak. There are a couple of mammals that lay eggs, but they give milk. Penguins do not have mammary glands and don't give milk so they cannot be mammals.

penguins are birds, because they lay eggs,and don't give birth directly to the offspring. not all egg-laying animals are birds, though. some are reptiles. Penguins are still birds, even though they can't fly!!

Mammals have fur or hair and give birth to live offspring (most of the time, except for echidnas and platypuses)
