I have a Lexmark printer why doesn't my scan button work?

The printer is about 2 and half years old and it was working perfectly fine until I just tried to scan a picture and it didn't scan. The copy button and the print button works but no the scan one. I am out of ink but would that make a difference?

make sure teh SCANNING software is correctly installed, use the CD it came with ans reinstall the scanning side of the software if requires
