I went and spoke to a lawayer about my DUI case yesterday and he asked me if i had a copy of my breathalyzer results, I said no and he told me that they should have provided me with a copy. Its a time issue on how long they took to test me and the breathalyzer supposedly keeps a record and he says i should have gotten this. It was a lawyer that told me this but i am still curious because i have never heard of this..I am new to the whole thing. Also, i called about getting a copy of my arrest report and they told me i could not have one today, I would have to wait until next week. Should i not be able to obtain my own arrest report on any day during the week, this sounded questionable to me but I am no law expert by any means.....any reasonable answers are welcome and will be helpfull......hopefully. Thanks in advance.

you will get one when you get a copy of the report. They might not give you the report now becuase it has to be processed prior to it being given out. As long as they dont go overboard on keeping it from you a week is a reasonable amount of time for them to get it for you.

I didnt work in law enforcement in tenn but I did in Illinois and we dont give you a copy until it is requested with the report., But an attorney should know this so I would go with what he said.

For the guy who said they should also give a sample to your attorney for private testing????? how do you give a sample of a breath test? I think he was talking about if they take a blood sample. However if you did retain a lawyer at the time of the arrest they could request a private firm breath or blood testing to go along with the police's test

It doesnt sound like you retained this attorney? you should he will do all fo this for you and you need an attorney in these cases.

If your attorney is at-all intelligent, then he has the responsibility, as your legal representative, to obtain copies of all reports, including your arrest, booking, and breathalyzer reports. If he fails to do so, then he is not providing adequate or satisfactory representation.

Yes! you should have gotten a copy- it's like a grocery store receipt- has the time, date, who gave it, and results. A copy will likely be attached to the police report so you will see it eventually.
