The suit cannot go to court, because we have legislated a separation of Church and State, which would prohibit God from appearing in the courtroom.
(as well as schools, legislative bodies, and anywhere else that could use a good dose of religion right now!!)

I think he has the right to sue God but I also think the judge should tell the senator that if he wants to sue God, he has to kill himself to hand deliver the summons.
