So basically, if I dont work for a company..but an independent practicioner that has a private practice that does not offer health insurance, etc.. then its in their discretion how long to give breaks? Meaning, I dont have a right to any time under NYS law?

Federal law does not require lunch or coffee breaks. However, when employers do offer short breaks (usually lasting about 5 to 20 minutes), federal law considers the breaks work-time that must be paid. Unauthorized extensions of authorized work breaks need not be counted as hours worked when the employer has expressly and unambiguously communicated to the employee that the authorized break may only last for a specific length of time, that any extension of the break is contrary to the employer's rules, and any extension of the break will be punished.

Bona fide meal periods (typically lasting at least 30 minutes), serve a different purpose than coffee or snack breaks and, thus, are not work time and are not compensable.

There is no LAW that say you get a break for anything, it is completely at the company's discretion. Look at you posters that should be posted by the time clock or lunch room, breaks only apply to minors. There is NO LAW federal or otherwise.

In New York state it's 30 minutes for 4-6 hours worked, an hour for 6-10 hours worked, and an hour and a half for 10-12 hours worked.
Plus 15 minute breaks.

I work 8 hours a day and I only get a 45 min lunch and no break. I think it may be state by state basis isnt it??

8 hours allows you a 1/2 hour unpaid lunch and two 15 minute paid breaks if you work for someone.

where do u live? the rules are different.
federal (usa) law allows a 15minute break per four hours worked. so for every 8 hours u work u can get 30 minutes break.
one hour lunch is NOT mandatory .
lunch break is Dictated by ur company policies, unless u work under Union rules.

No - There is no Federal Laws that require breaks or lunch.

There are some state laws, California for one.

You need to check your state laws, go to gov state.

What state are you in.
