If Person A is being investigated and law enforcement goes to Person A's school and makes him/her seem like a criminal by telling school administration that they have a criminal on campus?

Can Person A hire a private investigator to find out if something is going on? Can the ACLU help? Person A believes there are undercover cops following him/her around and maybe making him/her look very bad in other peoples eyes.

Is this legal?

If Person A finds out that he/she is under investigation behind false allegations, can Person A seek legal action?

What if the school is also involved in some wrong doing? What can Person A legally do?

Should the ACLU get involved and what are the chances of winning a case like this? Thanks.

The police have an obligation to investigate reports of criminal activity.

You will not be able to successfully sue the police based on any of the above facts.

You CAN, however, sue the person who made the false claims, and in my department, we charge those people with filing a false report.

This is a hard story to hear because I am a dog owner. I am also a cop though. Unfortunately it happens very often that while serving a search warrant officers are attacked by the owners dogs. I know in your case your dog wasn't attacking but the officer took the necessary precautions. It is a bad thing to read. You could try going into the police station and speaking to his superiors. If you do decide to take this route..do not go in with an angry and bad attitude because that will get you nowhere. I'm not sure that there is anything that the department will do for you but maybe you will at least get an apology from his chief and the officer himself. In saying all that, I am sorry for the loss of your dog. It is a sad story. The officer did not act professionally in laughing at you afterwards. In the heat of the moment though he saw the dog come running towards him and usually in those cases the dog is in attack mode. The officer should have apologized to you afterwards though. I don't think a law suit would really go anywhere in this case so it might just be a waste of money to get the lawyer. Again, being a dog owner and a cop I understand both sides of the argument. The only thing I didn't like reading was that you would laugh the next time an officer was killed in the line of duty. Not all of us act like unprofessional officers and that's something that hits home when an officer is killed.

I would find it unlikely. The police have an obligation to investigate all complaints and allegations, even those that prove to be false. Did the police know that these allegations were untrue before the investigation showed them to be untrue? Probably not. The police almost have to work under the assumption that the allegations are true and find evidence to show that the allegations are true. The fact that the police found no evidence to substantiate the allegations made against person A, does not necessarily make them civilly liable for any damages.

Can you sue? yes, definitely, you can sue someone for looking at you weirdly.

Does it stick on court? no of course not, they will laugh at you, call you an idiot, take your money and laugh at your face.

Can you hire a private eye? yes you can, could that private eye do anything about it other then tell you what is going on? no.

Police can do everything you have described with out any Legal issues, especially if there is a cause of suspicion. e.I phone call, anonymous tip, etc.... or simple gut feeling. Warrants aren't too difficult to get if they have strong suspicion, if worse comes to worse they can plant some minor evidence, not like its not been done before.

police can investigate anyone that they so choose look at John Lennon, Macolm X, Martin Luther ect not any legal grounds for you to do anything they can investigate anyone they so choose you only have trouble when they decide that you have done something wrong and charge you

an investigation decides whether or not there is enough evidence to proceed with criminal proceedings. the officers did their job.

The police can only get in trouble if that person is an illegal alien. Remember we aren't supposed to be racially profiling anyone. If you are caucasian, you are out of luck.

Sure, you can sue. But to be taken seriously, you'll need a lawyer, and for the lawyer to take you seriously, you'll need to come up with a retainer.

However, it may be wiser to cooperate with the authorities to clear your name, It you start threatening to sue, it may appear you have something to hide.
