I hope this helps, though this is not legal advice. The three of you will have to go before a judge to get this done. The mother has to give up parental rights to someone (you), so in essence you are adopting the child. Best advice is to seek legal counsel. You need to make sure this is done correctly. I'm sure you wouldn't want the mother showing up in 5 years to visit the child again because the "papers" are filled out wrong.

No matter what papers are signed, it still is required to be allowed by a judge.
