My ex-husband filed on me for full custody of our son in Oct 06 and will not let me see my son when it is my turn. We have been divorced with shared parenting since 2003 with no problems. My attorney has filed several indirect contempt charges on my ex-husband for not following our divorce decree on visitations. Plus he filed taxes each year when it states in the decree he is not suppose to. None of this has been heard in court or to anyone and it's been almost a year since this started. I have paid almost 10,000 for my case and now I hear nothing from no-one, attorney,Guardian Ad Litem no-one and I still do not get to see my son when it is my turn. I need some advice. I don't have the money to keep this going. P.S. My ex in contempt on other things that pertain to my divorce decree as well but nothing has been done.

The IRS has contacted me each year to send proof that I was legal to claim my son and my ex was not. I sent my divorce decree to show that he claimed him including my tax I.D. # for day care and still nothing has been done. I'm so confused and frustrated because I feel like I'm fighting a losing battle. There was no child support in my case because that is not what I wanted or needed and still don't. I just want my time with my child and the expenses I have to pay to support him should not be allowed to be claimed by my ex. The IRS and my attorney has done nothing. My attorney stated that I have too much to prove my case against him and that now we should mediate. I'm not the one that filed and did all of this, so why should I have to try to agree that all is okay when it was my time taken away and my money trying to get it fixed to prove he is not following the law.

I feel SO bad for you... I am in a similar situation, only not with my child, although I have had my share of problems there, too. I do know that you can go to the clerk of the district court where your divorce is filed and you can file paperwork for a motion for a change of custody, or a motion for a change of child support - either would get you back in front of a judge without the expense of an attorney. And, once you are in the courtroom, slam him with everything!!! I hope this at least gives you a starting place... Good Luck!

I agree with Lisa s answer and also notify the IRS with a copy of your divorce decree and what ever info you have.
