Laws SHOULD be fair and good for everyone. But that's ONLY in theory, in practice, laws are NOT for the good of the populace as a whole. Laws are intended to RESTRICT society, not FREE it. The ONLY ones laws are good for is attorneys and judges and jailors. Everyone else gets screwed by at least ONE law in SOME way, even if it's just a minor inconvenience.

People strive for an even handed distribution of justice, which is not something that Mother Nature does. Laws are supposedly designed and written to be fair and just for everyone, but they aren't always. Examples: women's right to vote was not enacted into law until the 20th century, slaver laws, segregation laws, etc.
They should be, because people get mad when they feel short changed, and it is a part of survival instinct to want the best for oneself and one's children. They also should be, because fairness is a concept of humans' not nature, and people will seek to find it where they can. They won't find it when their house is burned down in an urban fire but their next door neighbor's house survives unscathed.

They aren't fair and good for everyone. Your civil rights are fair and good for everyone. They make sure that the law doesn't overstep its boundaries and prosecute in an unfair way.

"Because they should be" is the answer.
What is wrong with the system is that the poor old prose cuter has limited time to read the law, and high powered attorneys can spare the time to look for loopholes.
