The Senator is making an important point. If men continue to invoke their gods names to promote war, terrorism, and genocide, then those same gods should be sued.

He's obviously not expecting some wrinkly old man with a beard to show up in court to defend himself - but just as you can't sue him (because he doesn't exist, except in the minds of believers), so you can't use god as a defense when charged with crimes.
