I have been charged a late fee on a Dallas County tax payment that was not late. In addition the fee I was charged is very excessive. The 8th amendment says "excessive fines cannot be imposed". How do I go about defending this violation of my rights?

I have already tried talking to the tax office. They won't budge. They are a government entity who could care less about providing good customer service. And yes I was very polite and nice.

Get a lawyer.

You probably won't get anywhere. Just because you think its excessive doesn't mean it will be prohibited under that clause.

Well, but the government has to set those non-excessive fine amounts. You won't get anywhere with the 8th amendment argument. If it wasn't late, then argue that to the county. If that doesn't work, either pay it or move.

Go to the county auditor's office to discuss this matter with them. Normally this is the office that handles tax issues. If nto, they will direct you to the appropriate office or department. Take your documents with you, like a copy of the check if you paid that way showing the date recieved/deposited stamp. If you used a charge card, take your itemized statement showing the date paid.

Hint: be nice. Don't say nuthin about any of your constitutional rights being violated!!! You'll look reeeeally foolish, and security will probably taze you in your tracks!

Wrong. The 8th Amendment deals with excessive bails and fines and creul and unusual punishment, not administrative late fees.

Good luck proving them excessive and pertaining to the 8th.

Pay your bills on time next time and keep proof that you did.

hire a lawyer and spend more fighting it than paying the fine...
