I got into a car accident back in January and the fault was technically mine. I thought everything to do with this matter had been laid to rest...until I received a warrant in debt last week in the amount of $15,000.00 I feel like I'm being taken for a ride here. Is my car insurance going to take care of this? I really don't know what I'm supposed to do. I certainly don't have 15,000 dollars nor do I think this woman deserves the money.

sounds like your insurance is not going to cover it, therefore the reason for the notice of 15K, they can place a lien on any assets you have for the amount owed

Call your insurance company first to see if they have received anything from this woman. If they have, then she's going after your insurance company and you need to express your concerns that this may be a case of fraud. You then need to get a lawyer. One that specializes in motor vehicle claims. Is the warrent in debt a judicial order? Like does it say you are commanded by judge so-and-so to pay this amount by this date? Or is it a letter from her lawyer or insurance company? If it's a judicial order, drop everything and get a lawyer fast. If you don't file specific legal documents and the date that you have to pay goes by, you could have a warrant out for your arrest! Either way. talk to a lawyer about this. The same thing happened to me about 6 years ago and I ended up having to pay this jerk $6,000 on top of the money my insurance paid out to fix his car. He was obviously milking me for every cent, but because I didn't have a lawyer, I was stuck paying him. Make sure you tell someone you think this lady is playing you!
Good luck!!!!!

Contact your insurance agent and find out who dropped the ball on this. They should have been in contact with you over the situation of the accident and telling you what was decided on and how much was covered by your policy. It may just be that it never got submitted and you are okay. Only way to know is through the insurance company.

If you had car insurance, they will represent you in this claim. The reason you were served is because you were the one in the car, not the insurance company.

Also, serving the person is more effective in the eyes of the person bringing the action, it makes you put pressure on the insurance company to settle. (No, I don't agree with this, that is why you pay for insurance. Unfortunately, that is how they do it)

$15,000 is the "limit" for this type of case. She isn't suing you for exactly $15,000. Courts have specific limits for different cases (i.e. small claims, circuit court, county court, etc.) Call your insurance company. If you have decent insurance, they provide a lawyer for you but you need to do it quickly. You received what we call (here) a "Complaint" and it MUST be answered with 20 days (in our State - Florida). But call your insurance company FIRST and NOW.

It's up to YOU to make sure it's taken care of, not just turn it in and forget it! someone thinks you owe the money so you better find out what's going on or start paying what you owe! If was your fault, it was your fault and you need to take care of what you did!

It's not up to you to decide who deserves what. Give it to your insurance and let them handle it but expect your rates to skyrocket.
