I also thought about doing this. obviously, you will have to select your legal entity (you would probably be a sole proprietor) and choose a trade name for your business (devil dogs, etc.). when you buy your cart, it has to be registered with the department of health. In order to have a business where you sell foods like that, you will have to have a "commissary" meaning some restaurant or commercial kitchen that is already licensed will have to sign a form stating you can store food and clean utensils at their location. you can't use your home. Your cart also has to meet specifications for the state, but most people selling carts will make them to fit the state requirements. This was the hardest part to me; unless you know someone it could be difficult. Some cities have local commissaries just for this, but my city didn't. you will need your dept of health license before you can get your city and/or county license (required to have any business).

remember those days when there use to be bastards on every corner selling lemonade? It's not so much unique but you think I can find one of them nowadays when mama's hot and thirsty? Noooooo. I mean Christ, it's 3 ingredients people! So, lemonade cart. For kicks some pink lemonade on the side for extra.

Your local city licenses these, you'd need to talk to your City Clerk.

Also, make an appointment with your local SCORE or SBA chapter, they'll walk you through the ropes.
