On my third day i fell down the stairs and got hurt went to hospital and the Dr. said i needed to stay home for a week. my manager called me n said to come back at least for light duty. now i called them to go back to work and they said that i was fired and they found someone else for the position. can they do that?

Loos like they can. Unless you have an employment contract or are a member of a union, you are an "at will" employee and you can be terminated at any time for any reason or no reason at all.

Did you go back to work when your manager called you to come in for light duty? If you did not, it was a lost time accident and your employer had to report it. If you are not in a union shop, then YES, you could be fired.

Depends on your State of residence, in my state they can not because it is a workers comp injury. You need to file a workers comp claim, file an OSHA complaint, GET A LAWYER, and document everything you can. A chronology of the events and conversations, etc., your recollection of the accident, the physical layout of the area in which you were injured, record all medical expenses and mileage, etc. Again, GET A LAWYER soon and Good Luck !

I think if you have a Dr's excuse they cant fire you for that! I would call legal aid and see what can be done! I hope that you recover quickly and feel better soon! : )

Hit them up for unemployment. I am not sure what the grounds are for firing. But you have a case there for unemployment.
