I want to start a home based business selling home decor. ive noticed that in the fabric stores they have alot of material, other items with animated characters from popular companies i dont want to mention. i want to use these fabrics in some of my work, sell it, but dont know if its legal. i know a little about copyrights laws, but im confused because the materials are in a fabric store, and the companies know people shop in fabric stores to use material to make, create new things.

As long as they fabric was licenced to be made and sold the way it was, you can use it how you wish.

Since the item is already in a store, made then you are safe as the store owner is responsible for the © on the product. Most likely the material maker got the deal to run the material.

Now if say you made up an embroidery logo that was of a character, then yes, that would be in violation of their ©.

I was going to open up a store like a Looney Tunes store and wanted Bugs Bunny on my logo. But no one would stitch it for me due to ©.

Doing what you are doing you are fine and in the clear. If you really feel worried you can always put on your site or on the paperwork or what not, " company name © " in small print somewhere just to give recognition to that company.

The best way for you to be protected is to have the client purchase the fabrics directly, then you can make the decorations out of it for them without the trademarks ever being an issue. If you buy the license ware and then make commercial re-use of it, that could be a trade violation. You could have samples of your handicraft in the store for display purposes (not for sale) only. For example, you could display how you make a shower curtain from bulk fabric without becoming a trademark issue.

It probably is OK but I recommend calling a patent attorney for the peace of mind. I also would contact the legal dept. of the characters in question. Get an answer from them in writing and keep it in a safe place.
