He needs to prepare his taxes for those years to see where he stands. If he owes a great deal the IRS may work out a payment plan with him. If he made that amount over that period of years the amount he might owe may be small. Its not going to make any difference if you file jointly or separately. The IRS is going to try to come after you too. You may be able to file an Innocent Spouse claim. But I wouldnt count on that.

Ignore eric54_20. He is just spouting lies. The IRS sends a lot of people to prison every year who try to make those same arguments. The IRS even has a page that tackles those argurments and even lists cases where they were used and the people trying to use them were prosecuted.

I would suggest you not marry this guy until he has paid his tax bill. If he refuses then I think you should consult a lawyer to find out exactly what your liability will be if the IRS gets this guy and you are married to him. Also, here is a link at the IRS about innocent spouce information.

You didn't say whether his employer withheld taxes from his pay... you also didn't say whether the income was reported by the employer...

You're supposed to file a tax return every year regardless of income.

If it wasn't reported, then the IRS doesn't know about it.

If it was reported and taxes were withheld, he may get a refund by filing, or he may owe a small amount (and some small penalties)

If it was reported and no taxes were withheld... still no big deal - taxes on 10k per yer year is almost nothing.

DO NOT FILE JOINTLY WITH HIM until he is square with the IRS and can show you returns filed by a CPA or IRS approved tax practitioner.
Once you are married, you could be financially on the hook as well.
Any home or property you folks purchase may have an IRS lien placed against it. That will make it difficult to sell.
He may be handsome.
He may be fun to be with.
He may rock your world.
But you both need to include financial affairs in your premarital counseling.
Finances are a key reason for divorce.

There is no law that says he has to pay income tax.....sounds funny but it is true. The IRS is enforcing the payment of income tax illegally because there is no law......

Watch the movie FREEDOM TO FACISM its a great documentary and you will see people that beat the system because they told the court to 'show them the law that states they are required to pay taxes'......the law does not exist! He should go ahead and lube his butt up now so when the IRS comes it won't hurt too bad. There are heavy fines for not paying.
