I thnk you should insist on a paternity test. 41 weeks would mean she got pregnant December 5, but there's some weird thing doctors do where they count from the date of the last period, not the date of ovulation. Also, were you there when the doctor said 41 weeks, or did she tell you that? Because she may have some reason to tell you it's the exes and not yours, or she could be telling her ex it's yours and not his.

41 weeks puts the date of conception around December 10th. December 15th would probably put the baby more at 40 weeks than 41. Conception in November would be more like 43 weeks, but you'd also probably need to know some details about when she usually has her period to know what is and isn't possible. If her period is usually around what would be December 10th and that's when she missed it, there's no chance you could have gotten your half of the genes into the little egg, but if her period is more around what would have been Thanksgiving or just after that, then unless she was with him in the week or so before you were with her, it very well could be you. The issue here really, though, is who is going to be the father of the child more than who fathered the child. She's your ex and she seems to be sending pretty clear messages that she doesn't want you involved (although you know the details better so maybe she's just trying to be "nice"), but as things stand, it looks like you'll have to wait until next time to be a daddy.

Facts :
Birth was 17th September.

If birth was at 41 weeks, conception would have occurred between the 14th and the 20th December.

If birth was at 40 weeks, conception would have occurred between the 7th and the 14th of December.

A doctor estimates delivery date by the date of commencement of last period provided to the doctor by the woman.

It's also normal for gestation (the time of pregancy) to differ between women by up to 2 weeks either side.

The only way you have of knowing for sure is to ask for a parental test to be done.

She would have became pregnant december 4th, if she was exactly 41 weeks when the baby was due. Do you remember her ever having a period while you two were together, complainin go her breast hurting, morning sickness or anything?

My advice, try talking to her first. If she doesn't listen leave HER alone and contact a lawyer. Get your dates together and try your damnest to get her to take a paternity test.

I have a son who was born September 18, and he was conceived in December. So i'd say the baby was perhaps conceived in December. You can always ask for a paternity test to find out who really is the father. Goodluck

Well, to be sure, ask for a paternity test. However, I've heard that the gestational period all told is really about 10 months.

Also, sometimes babies just don't want to come out! I have a friend who was born about a full month late.

There is no telling when exactly she got pregnant especially since a full term pregnancy can be anywhere from 37-42 weeks...the only way to be sure of who the father is is to have a DNA test done...best of luck.

That's tough, simply ask her for a paternity test, or else try and speak with the ex and get him to push for one since she is claiming him as the father. Either way you can pursue it legally just to give you a piece of mind. I am hoping if you found out it was yours, the reasoning for wanting to know is you want to step up to the plate. Either way it sounds like you have a right to find out.

I agree with everyone else. Claim what is rightfully yours.
