for workman's comp was bitten by a spider on the job as a result a staph infection developed. When I was return to work , my supervisor was upset b/c he had to work my one of my shifts. And said that was a no call / no show. Apparently paperwork was not recieved from the doctors office in time. Said it was my responsiblity to get it to them . My question is with workman's comp whose resposibilty is it to insure paper work is properly done in circumstance wir the employee is hospitalized? please keep in mind I live in the state of arkansas and it is an at will state.

Were you able to pick up a phone and notify work you wouldn't be in? Could you have asked family or friend to do it?

If you were able to notify them, why would you leave it to people you don't know?

If you were unable to, tell your boss that you were unconcious or whatever. Otherwise, I think your boss is justifiably pissed.

Most companies run Family medical Leave concurrently with worker's comp leave - meaning that an employee on WC leave is on FMLA at the same time.

There is a provision under FMLA leave which allows the employee up to 10 days AFTER the start of a leave to notify the company, for example, in the event of a hospitalization or other emergency.

That being said, it is the employee's job to notify the company since any work contract is between you and your employer (not between your employer and the insurance company.)

Well no harm was really done. Your supervisor was upset because you didn't turn up and he didn't know why.

Just apologise, offer to fill in for some of his shifts for the poor guy, buy him a beer.

You were in hospital with a serious infection and things didn't quite work out.

Don't make a big fuss about it. It was just one of those annoying things that happen, though next time you would want to make sure everything is cleared up and understood (many times people take time off, or are sick or something and the message doesn't get to their supervisor and the brown stuff hits the fan)

Worker Comp usually is on the side of the EMPLOYER, so it is always in YOUR best interest to keep copies in your possession of your doctor visits and copies of the chart notes. If you get fired, you can seek assistance from a good employment lawyer and probably get re-instated, but how happy would you be there?
