Slavery was ultimately abolished in the Thirteenth Amendment.
You have to remember that the Constitutional Convention was trying to establish a true national government. It had to get a consensus between all of the states. As such, it had to protect the slave states.
Contrary to a previous answer, the original text of the Constitution treated slaves as less than humans and as commodities in two separate clauses, both of which were necessary compromises to get any text adopted. First, slaves were recognized as being only three-fifths of a person (unlike women and children who counted as whole people) for determining representation in the House of Representatives and for taxation. Article I, Section 2, Clause 3. Second, Congress was precluded from banning the slave trade for twenty years. Article I, Section 9, Clause 1.

Because it was not a legal issue.
"We the people" it did not say we the white people, we the males, we the females, we the god fearing ....yada yada yada
Slaves were a commidity. But they were human none the less. The Constitution is very clear about the fact that it is we the people. Yes only white 21 yr old male land owners could vote, but no where did it say anything about slaves.
Why? because our founding fathers knew that slavery one day would be outlawed. And they left it out of the constitution so that the slaves would have the same rights.
Unfortunatly it did not work out that way.

It was, i believe the 18th amendment covers it. The problem was that the Southern States threatened to walk if anything addressing Slavery was put in the constitution.
