If you own the property, you own the tree and are therefore responsible for damage/injury caused by the tree.

The house owner is responsible for any injury or damage caused from a falling tree onto a neighbors property if the tree was originally on the owner's property. The house occupier may not be responsible unless he/she put the tree against the wishes of the owner. In that case, the owner will responsible for any damages to the neighbor, but the occupier may be responsible to the owner for reimbursement of that amount plus any other fees the owner incurs.

Gypsy is right. If the branches are on the neighbors property and they fall it is NOT the responsibility of the Owner of the tree.
It is illegal to go on to someones property and trim tree or branches even if it is your tree. Also an owner can not stop a neighbor from trimming branches that are hanging over on to the neighbors property.
People have a responsibly for their safety in this matter.

If the branches are on the neighbors property and they fall it is the neighbors responsiblity. An owner of a tree can't legally come on to someone else property to trim their tree.

Now if the branch or a tree fell that were all on the owners side on to the neighbors property the tree owner would be responsible. Law 101
