Only a lawyer can tell you for sure. But you will need to show damages. If your daughter had no ill effects, that may be a difficult thing (but not necessarily impossible) to do. You need to talk to a lawyer. And stay away from that Pharmacy!

First, I would have her checked out by a doctor. I think you should at least check into filing a complain with the state pharmacological board or which ever bureau issues license in your state. As for suing I am not sure it would do much good unless there was damage, which, hopefully there is not. I always double check the meds and sometimes the manufacturers change and the meds look different. My pharmacists knows to tell me or he will get a call before I take one. Good luck.

I work in the medical industry and advise that you definitely report it to upper management of that pharmacy. You should also find who makes the 2 medications and call those pharmaceutical companies. There have been a few cases in the past where this has happened because of similar names of medications and the names of the drugs had to be changed. If it is not a possible name mix the pharmacist could and should loose his job. That is a careless mistake that could easily take someones life!

The pharmacist made a grave error and should be reported and followed up. I would contact a legal adviser (for a small fee or free legal aid) and let your local agency and store management know what happened. This could have happened to the same pharmacist in the past.
Name the person, date, name of meds. etc. and keep copies.
This could have been very, very serious. It is important to report it to the proper authorities in your area.

Call the pharmacist and ask what the heck is going on. Did he misread the prescription? His tech messed up filling the meds? Get in there and fuss, and then find out from the doc if it was bad for her. Then debate on an attorney.

In todays day and age, people are so sue happy, just a quick easy way to make a buck. (and sometimes not so quick or easy) People forget that people are not perfect, granted in a job like that, it could have been a fatal mistake. I would say forgive and try to forget...maybe switch pharmacies. I would look at the pills from now on and if they look different, question them, ask if they changed the pill and have him double check them then. It is a scary thing.

I'd sue. You never know what could happen to your daughter in the future. Sometimes the aftermath doesn't show up right away.

I agree with everyone else that you said has been telling you to sue! Thank God your daughter is alright! Don't ever go to that pharmacy again, switch right away.
