OK. Over the summer I was sexually sbused by my 12 year old brother and since he was 2 months away from 13, they said they coulsn't do anything other than informal probation. Do you think that is wrong since in some cases minors are tried as adults as young as 15, 16. I am 14 by the way.

This was in Iowa also. SO I don't know if that would have anything to do with state law. He's 13 now.

I know. I feel unheard. Because, in every conflict that is legal between two people, there are two stories and they didn't talk to me. I feel like he got a slap on the hand and I got life sentence to unfair treatment. It's just not right. I might be young but I can see this isn't right.

Well, they said the difference between 12 and 13 is 12 year olds are "curious" and 13 year olds know what they're doing. That is exactly what they told me when I started yelling at the cops. Then I got in trouble because I kicked his @$$ which I admit isn't the most mature way to handle things but did it feel good. This world is so f***ed up.

Well, that's the other thing. I don't live in Iowa. I was visiting my "other" family, (dad, step-mom, step-brother, step-sister) and the night he did that, (I was asleep), was my last night there and I left first thing in the morning. I didn't even get dressed I just picked up and left. I was walking to the airport and realized that I needed parent signature to get on the plane so I went back. But I don't speak with any of them anymore.

Yeah he was abused as a child. Everybody in my family was abused as children. I can't think of one person on either sides of my family that weren't abused. But I'm not one to shut down and not say something when I know it's wrong I made the biggest scene I think I could've and it felt pretty damn good to do that. It seemed to be the only way I could be heard at the time because they kept telling me to shush. I'm just lucky I didn't get taken into custody.

I think it is very wrong, I was sexually abused and it hurts the abused when we cannot see results. I think the abuser should be prosecuted regardless of age. Trust me if you shot the shick out of him for raping you, you certainly would have been found guilty. What's the difference? Do you know how many women are currently incarcerated for commiting a crime against their abuser? Come on when will the law change to protect us?

The problem here is that at SOME point you have to draw the line about whether you try someone as an adult for a crime committed by a child. They have decided after a good deal of thought on this issue that 12 years old constitutes being a child. Should he be punished? Of course he should. Even more importantly he should be forced to see a therapist in order to discover WHY a 12-year old is abusing his sister. There's something wrong with him. Did your parents do anything about this? Was HE abused in some way growing up? There are lots of factors here that need to be considered. Usually when a 12 year old commits a crime, there's something seriously wrong at home.

I'm sorry for what you have gone through. I'm a survior as well, so I know how you feel. Personally, I think your brother needs help and should be placed in a facility for treatment so he doesn't offend again. However, there are no guarantees for this. But when a person starts as young as he is and he gets away with it, it is sure to happen again. I hope that your parents can see this. If you are still living in the same household, it must be hard for you. You need time to heal and to sort out your feelings and work out the trauma. I hope you are getting help. Please do because you don't want it to ruin the rest of your life. If you see, something out of the ordinary happening with your brother, don't hesitate to contact the PO. Get him help, before he grows older and thinks that it's okay what he did.

I know how you feel but even if the law doesnt punish them then your parents could do something about it I was sexually abused by my uncle when I was 7 and im 18 now I barely told my parents but it really hurt me because I feel like he is the reason that I dont feel loved by anyone anymore and its something that you will never be able to erase from your memories. But just hold in their and dont think of ending your life just because justice wasnt made ok if you need to talk im here for you

I agree with Molly. I also don't understand why the law would be different for a 12 year old versus a 13 year old. I am sorry you had to go through this - the sexual revolution has destroyed this country.

It probably does have to do with state law. However, that really isn't right. I suggest you send an e-mail message to your state's congressmen and representatives. Send messages to your city mayor as well. I wish you the best and hope that you prevail.

Yes, I think that's wrong. We don't have all the facts here, but in general, it seems like a sterner punishment would be warranted.
