Rights, laws and protections which would apply to AI already exist on the books.

There are levels of legal protection according to the various levels of life forms.

As AI life forms become more satient...human like...they will rise up the ranks of those pre-existing legal protections.

Of course they will have rights but their rights will start out as an extension of their owners rights. Until AI are smart enough to be considered intelligent life the question is moot. Thinks things will fall on both sides of the line in different countries.

Needs a shrink to check off the things needed for intelligent life things like self awareness, awareness of others, awareness of the implications of things, awareness consciousness, awareness of time and space and the other dimensions that help define human intelligence.

Things will get really confusing when we start building biomechanical machines.

First we need to define what exactly is "artificial intelligence". Can intelligence be "artificial", and if so, why isn't ours?
