and if you do settle is the time limit shorter to receive your money?

Your answer could be given in two ways,I think.What is true in legal THEORY. What is true in REALITY. In the real world it is better to settle out of court most times. The reason that I say this is because it is sometimes difficult to ACTUALLY collect the judgement sum that was ordered by the court. There are many ways that the losing party can AVOID payment.You will find them much more eager to actually PAY you a settlement that they made out of court because they will know it is in their own best interest to stay OUT of the courtroom. The ruling of the court can sometimes RUIN a company and cause them to bankrupt. Is your true GOAL to bankrupt the company or do you really want the money?Are you just trying to send a message to the OTHER companies like the one you found fault with? There is less chance of collecting a judgement than there is of collecting an agreed upon amount from outside the courtroom.

Usually it's faster when there is a settlement, but it depends on the actual language of the settlement agreement. You can specify, for example, that the action won't be dismissed (in court) until the funds are received and cleared by the bank.

I would say, out of court. Get the money before settling. Getting a judgement is much easier than collecting one.

'getting your money' does not depend on how the jusgement is handed down or arrived at. It depends on the exact wording of the order / Agreement and how good your attorney is at drafting the demand.
