Why should a moon orbit the planet's equator? The only requirement of an orbit is that it revolves around the centre of mass. A captured body need not orbit over the equator. A body slammed by meteorites large enough to cause massive impact basins might just be nudged off its plane.

And the Moon does not orbit on the plane that the planets orbit the sun at all. It is tilted five degrees from that.

There's no reason that a moon should orbit the Equator. In fact, the Moon (as most moons do) orbits in a Cassini State, which is an orbit that balances torque from the planet with inclination of the orbit. This does not occur exactly at the equator, and so the Moon does not orbit there.

Because the Earth's axis is tilted 23 1/2 degrees.
