Yes definitely correct, it is right what the waitress done to the customer when she slap the over bearing customer that has done her the sexual harassment in tow.

We presume that the sexual offender is a male, obviously, regardless of the physical built of the guy. A waitress which is definitely a woman of stature, no need to presume she is a woman. Because no guy would be address as a waitress. Because of the assault that was done by the perpetrator in this case, a woman attacked by a guy disregardless of the time and the place, would certainly fight's back as per natural instinct of human being, the guy is more luckier that only slap or kicks he only got, other women now a days carries gun or some paraphernalia against intruders.

So your only question is if the gesture or the manner of the waitress in the said situation is right or wrong? Yes it is right to do that and if the other guy would sue the lady, sue her for what? He started it. Why would an attacker sue the victim?Doesnot make sense? The waitress has the right to sue the offender not the other way around. A dispute between a MAN and a WOMAN, who do you think the court or perhaps the judge would side on? Of course with the woman. Because the woman is still considered the weaker sex genetically.

I think she has the right to slap the dirty codger. The law says otherwise. It is the law we have to pay attention to here. The waitress will have to file charges against the knave, and pay out of pocket for it. But ...if she slaps the coot, chances are he will take his lumps and leave, should he take her to court her defence can very well be " self defence"! After she wins then she can take the culprit and sue for damages, then sue for sexual harassment.
But why bother the system with that tomfoolery when a defencive slap, and a humbled offender can settle the matter in minutes, without undue stress nor cost of courts.

It's only sexual harassment if you are at a place of employment or a school together.

If he physically touched her in an inappropriate place than that is assault the same way as if you just punch somebody in the face. If this is the case than what she did was self defense and she will most likely not be charged but can still be fired.

Though many would feel no sympathy for the customer, under the law, the waitress has committed assault 4/5 and simple battery.

The waitress must have filed a criminal case of acts of laciviousness for his wrongful act. She could have controlled herself not to slap him although she can claim that it was an act of passion since she was offended.

If it's only verbal harrassment, then probably the best thing for her to do is to "accidentally" spill a drink on him and order him to leave. If he touched her, then that's assault and she should call the cops on him (after spilling the drink, of course). I wouldn't recommend retaliating by slapping the customer, because he might file charges for that.

i personally myself would have sexually harassed right back , but not in a fun way , i would have made the customer think was i a sexual devient sex freak , with genital herpes stalker women , he would have been sorry he even messed with me , I would have told him i just had gotten out of prison for sexual abuse of a elderly patient at a nursing home, i was working at , b4 that i was in serving a sentences for breaking several restraining orders...I would make sure he would never sexual harass again lol use words to fight

She should have called the police, called her boyfriend/husband to meet him in the parking lot and have a little workout... then sue the daylights out of him.

i didn't hit anyone but i did accidentally spill their orders all over them.....with support of the management who would have had to kick them out otherwise

She should have just told her manager instead & had him thrown out. Now she can be sued & arrested for assault.
