A buddy of mine is a custodian at my daughter's elementary school. I just found out that during the kid's lunch which is about 20 minutes for the students, but an hour and a half overall for all classes combined. He is left alone with the students with no additional adult supervision. It's become his job to supervise them, line them up and even send them to recess. He tells me that he has no certification or proper training in supervising kids and that his responsibility should only be in normal custodial duties, however because of an article in his contract between the board and union, he is to do whatever the principle ask of him, if he doesn't it is considered insubordination. He wonders if there is some law that states only certified people can be left alone with children and if so who does he (or I for that matter) contact to report this violation?

department of education ?

i do not think that students / children may be left alone in a room without any licensed teacher.

i believe a licensed teacher must be in the room at all times.

has he considered to ask the state department of education?

It seems to me that a teacher who probably makes a considerably larger income than a custodian should bear the responsibility of the children and not the custodian. I would have to report this to someone.

I think it is okay. My mom is an aide (which is not certified) and she has kids by herself. It is pretty normal for the custodian to help with the students. He can get a job somewhere else if he doesnt like kids.

It must not be a law where he lives. Schools are pretty particular about adults who are in charge of kids for any amount of time. He probably had a background check before he was hired.

Children doing things that can harm themselves and other are EVERYONE'S responsibility. You are right to want to help. I understand your not wanting your kid to be singled out as a nark. So call the school counselor without telling them who you are or who your child is, and tell them what you know. About the boy getting high, and about the boy at school selling it to him. It IS our responsibility to keep all children safe. Good for you for wanting to do something, now DO IT!

Contact the local school board. They are made up of parents, they would be horrified to find this out. They also have the power to fire the principal or at very least stop this from happening.

legally, he just needs to be employed by the school system. this is just lunch, so he doesn't need any special training or certification to be with the children. personally, I think there should be another adult present.

Depends on where the school is. Some states and towns have such laws. Some don't.
