Since Friday 27th July 2007, all bank charge claims are currently on hold, pending the results of the OFT Test Case. However, if you haven't claimed and would like to, it's important to get register your claim with the bank as soon as you can, in order to "lock" the date that you can claim back to. With every day that goes by you may be losing the chance to claim back older charges!

Not sure when there will be a ruling on the penalty charges, but I know that there are a few bodies looking into it, such as the Office of Fair Trading, and the European parliament.
If the outcome is ruled in favour of the customers, then the banks will seek to craftily sneak in back door charges, e.g. higher interest rates on loans and credit cards. that's what some banks and credit card companies have already done, when the OfT ruled that there should only be a maximum charge of £12 for a missed or delayed payment.
That's the evil face of capitalism for you, I'm afraid. Banks rake in an obscene amount of profit anyway, and with the exception of the Co-op and Nationwide, most of the big banks help to fund the arms trade, leading to global conflict around the world.

Martin Lewis at www.moneysavingexpert.com will keep you up to date on this in his website. You can still claim back the charges from your bank for the last 6 years but you will have to wait until the case is decided. Check the website.

I'm not sure what you are talking about? where is the test case? I don't think any court is going to outlaw bank charges.

There should be bank charges. The same people who are complaining are the people who would shout most if someone was using something belonging to them and not paying for it.
