The police officer said he wasnt sure, but for the first offense he thought it was only a fine, but after that they do. Is he right?

This is up to the judges discretion. He can fine you or also withhold you from obtaining a license until you are 18. A lot will depend on why you were stopped and ended up in his court.

My little brother got this in June. He's 17, no license, he stole and totaled my sister's car. All he got was a $200 some odd dollar fine and he can still get his license in April when he turn 18

If you are stopped for underage driving you shouldn't have a license for them to hold unless it is a fake document.
