My employer stated that I needed to take my maternity Leave since she had no postion open for me that would allow me to sit. Now since shes the one that put my on maternity leave and I didnt request it does this count towards my 6 weeks....

They cannot force you to take maternity leave early! Look into FMLA-Family Medical Leave Act. There should be a rep for you to talk to. Also, if you have short or long term disability, you can use that now and start maternity leave when you deliver. There are so many laws in place to protect pregnant woman from employers like yours, don't let them bully you. Or tell them to lay you off and give you unemployment.

Yes, but it's not really 6 weeks, its 12 weeks. If your doctor has given you modified duty and your employer cannot accomodate, then you need to take a family medical leave, and they CAN terminate your employment after 12 weeks. If you believe you are being treated unfairly due to your pregnancy, get an attorney because being pregnant puts you in a protected class.

actually no but you can still get your ob doc to put you out on state disability as he/she has requested that you have a light duty/sitting job and there is none available. It would go against you only if you were offered a sitting/light duty job and you refused it, If your employer tells you differently go to the labor board as it is illegal for them to deduct the 6 weeks time frame if they did not have a job that was in the MD's specifications
