Its not the full song just 1 minute. It doesn't seem like it would be legal but does anyone know for sure.

You cannot use the copyrighted works belonging to someone else for commercial gain.

If the song is yours - you can sell them a promotional CD as long as that is how you market it (like "previews" on Amazon or Rhapsody, etc.).

No, because you have to submit requests to the publisher and record company that owns the rights. It's not for you to sell, that's where it is illegal. Even a drum beat has to be submitted. That's why trading is better, not legal but doesn't raise eyebrows. I'd love to know what that 1 minute would be to be worth selling.

Depends what the person doing the purchasing is expecting. If you disclose the full details of what you are selling and they buy it anyway, then it's legal.

If you mis-represent what you are selling, then it is questionable and may be illegal. But there's an old saying - "let the buyer beware" and that applies here too.
