Am answering this question on the assumption that this is not a pending case.
There is a concept in family law called "Triennial Cohabitation". Pardon the spelling because I do not have my law book just now. At any rate, under this concept, a zero-sex marriage is unconsummated and therefore may be annulled. There is no need to allege psychological incapacity.
But since you asked, yes, the repeated unreasonable refusal by one partner to have sex with the other for an indefinite period of time may be considered psychological incapacity.

First of all sex to some is a big part in marriage and they were married at 18 years old and one because he was pressuredd by his parents when they were still lovers go married and but they never have made love between the both of them, yes he could get a divoice on psychological incapacity. Let this mand go if you dont want to forfull your duties as wife. enough with this g &b stuff it is kind of confussing to get the story straight.

I believe you can, but it's not called pyschological incapacity, it has a different term, my sisters an attorney and we actually discussed a case like this while she was still in law school, I believe it's called non- consortium (not sure if the spelling is right but the tium part is pronounced like "shum"

In the US, if you never had sex then you didn't consemate (sp.) the marriage and it should be annullable.
Sort of odd that two people would have the legal rights to make love and then didn't but to each its own.
