If you are employed and they say you cant use the Internet for personnel use than to do so can be a crime in theory (abstracting electricity and stealing Internet use a new offence).Of course they can monitor you whilst you are on their system and using their equipment.You don't have any human rights regarding your employer allowing you to use the time they are paying you for to use their Internet access or to use their equipment at anytime without explicit consent.

The US Supreme Court said that the Internet accessed from a company computer and on their server is there property. They can read ALL emails sent or received on those machines and monitor what they are being used for. They took the view that a computer is no different than a drill press, and what you use it for is the companies business.

This is a most interesting query! Does the employer pay you per page of work done or per time you are at your desk? You state that you arrive early in order to check your e-mail, and you would think that some agreement could be reached that would permit you to access your e-mail before work hours, but it does not sound to me that your employer would allow this, unless your efforts on behalf of the employer are particularly appreciated, which is to say that you do such a fantastic job that the employer might give in. The best thing to do is to ASK YOUR UNION REPRESENTATIVE AND LET HIM/HER TAKE IT UP WITH THE EMPLOYER FOR ALL THE EMPLOYEES rather than calling attention to yourself. Employers are people too--I wonder whether the bosses have to follow the same rules as the employees? I bet they don't! Sometimes people can be considerate and cooperative when they wish to be! Obviously you should likewise be respectful of the employers and not conduct your BUSINESS on their time; after all, time is money, and that's what they are paying you for! There are other companies with a different attitude...so, "Go see what the competition is doing!"

I don't know about the technicalities of the law, but it makes sense to me. You're not at work to slack off; you're there because they hired you to do the job. You are essentially wasting their money. I'm not talking about you in particular, but people in general.
If I owned a company, I would do the same thing.
