I turned in a 30day notice along with my rent for the last month. The supervisor was aware of my 30 day notice as she came to check to the apartment prior to my leaving. There was no damages, however i was denied the entire amount of my deposit because the owner claims it was not dated. Moreover i did not receive this claim more than 30 days after i left; and I my 30 day notice was never rejected

This may not help you now, but when I was renting, I always took two copies of my 30-day notice to the landlord, and had them sign an acknowledgement of receipt. That way I had proof of when they received the notice.

The burden of proof is actually on her to prove that she did NOT receive it on time. I would sue her for the FULL deposit amount. It's your word against hers, and usually the tenant will prevail in those cases, especially since she also has no evidence that she sent you any notices regarding that you moved out without proper notice.

There are often local laws about deposits, since it's an area that has been subject to so much abuse by landlords. Check yours out. In some places, if you don't get your deposit back within 30 days or an itemized list of the deductions from it, you are entitled to get the whole deposit back plus penalties.

Are they claiming it wasn't turned in 30 days ahead of time, or just that it wasn't dated? They could look pretty silly in small claims court.

Good luck.

All states have different laws regarding this matter. If I read your question properly it has been thirty days since you have moved out. If this is the case in PA as long as you left a forwarding address or some means of contact. The rental person has to send you a detailed list of what the security deposit went to. If this is not done you can take them to court and get double your money and sometimes court fee. Good Luck.
