i am a dental assistant and my boss doesn't give me any paid breaks, i live in colorado. in my last job i used to get 2 paid 15 minutes breaks in an 8 hour shift and a half hour unpiad lunch break. my actual boss doesn't schedule lunch breaks and it's rare when we get lunc breaks.
my question is: is he required to give two small paid breaks like my last job?

You should get 2 paid (10min) bathroom breaks

If you are required to stay on primeses for your lunch, then they must pay you for your 30 minute lunch break,

if they do not pay you, you are entitled to a 30 minute lunch break to go anywhere you want.

For example if you work from 8am to 4:30pm, that is 8 1/2 hours,

if you are given 30 minutes lunch to go where you want then they only owe you for 8 hours of work.

If you must stay at your place of work for your lunch (eat on the job) they owe you for 8 1/2 hours.

Based on my previous work experiences, the government mandates one hour paid lunch break and 2 paid 15 minutes break (one in a.m. and one in p.m.) In cases wherein workload does not permit, a half hour paid lunch break is given and the unused 30 mins./per day can be rescheduled. I believe your boss needs to give you these breaks for humanitarian reasons and as dictated by law.

Go to the Colorado govt website for that state's wage and hour laws. My understanding is (assuming there is no collective bargaining agreement or other contract) they may have to give you breaks but I'm not sure that they have to pay you for them.

Federal law doesn't require it, so it's not the law for all places in the US, but it looks like Colarado law does - see http://www.coworkforce.com/lab/AB.pdf page 52. The breaks (10 minutes) are paid, but they don't have to pay you for the lunch period.

I'd suggest that you print this page and show it to your boss - he or she might not be aware of the law on this.

Just remember this when you vote. Republicans are all for the business owner and care little for the rest of us 'cause the workers are stupid and don't contribute enough to their campaigns. There won't be any labor laws if they stay in power.

What does your state labor law say ?
Don't employers there post copies of the states labor laws in the employee areas ?
Have you called your state labor board ?
