YOu don't say if this is FSBO or a Realtor.
If you are working with a FSBO, they can do basically whatever they want.
If this home is for sale with a Realtor, put an offer with earnest money on the table.
People may think you cannot buy, until you provide an offer with a pre-approval letter, that may be the opinion they hold. He may have what he thinks is a serious buyer on the line, and is slow walking you because you haven't stepped up to the plate with an offer and earnest money.

Does he have a Realtor he is lising the house thru or is he a FSBO? (for sale buy owner) If he has an agent then put the offer thru them, the agent will bring the offer to the owner, he will have no way of knowing who is purchasing his house, he will accept or reject based on the offer he receives not on the race or religion of the buyer.
There are laws that prevent discrimination against any one based on race, religious preferences or disability. If you feel that you have been unfairly discriminated against by the seller you have rights and you can file a claim against him.

I see chicken little is here again (dontbuy2007) run chicken little, run the sky is falling. First it's, my husband and I have found a house. Not trying to be rude. Maybe the seller has someone he knows, looking at the house and said he would give them a couple of days or maybe he thinks you can't afford it. But the bottom line is he can sell it to who ever he wants. Have you and your husband been pre-approved? Also it is his business and worry if you have the money or can get funding. If he signs a contract with you and you can't get a loan or don't have the money for closing, then you have wasted his time, and time is money in real estate.

Did you make an offer in writing? Was there a counter offer? Is this just all talk? Have you been pre-approved by a lending institution so that at least you have proof that you will qualify? To see the other side of the coin, I wouldn't want to waste time with buyers who won't qualify, especially with today's mortgage issues.

Put your offer in writing, with a reasonable response time. If someone else is interested, this will give the seller proof to them. Their are resolutions if you offer a full price on the property, and he rejects it, they very from state to state, but R.E.S.P.A. rules apply to the whole country. If you have proof of any type of discrimination, report it to proper authorities. Good Luck!

Perhaps he has a potential buyer he is giving the chance to commit to a sales contract.
Barring issues of discrimination he doesn't have o accept any contract on the house that he does not want to even if it is 100K OVER the asking price.

Have you put in an offer in writing? Are you working with an agent? If you are working with an agent, tell her to put an offer on the house. Do you have your financing lined up? If you want the house you have to move on it.

He can accept or reject your offer. If he is working with another potential buyer and is waiting for them, that is his choice. He does not HAVE to sell to you.
