if its not secure and ur not downloading or viewing anything illegal i dont see how it could be ... its like an open invitation and most laptops will automatically link up to it ...

Everyone keeps giving opinions on this when the LAWS are clear. YES it is illegal in every State of the US.

If you connect to a wireless Network, you are connecting to that network! That makes you in violation of the laws.
Here is a quote from the NY laws
N.Y. Penal Law § 156.00 to 156.50
§ 156.05 Unauthorized use of a computer.
A person is guilty of unauthorized use of a computer when he or she
knowingly uses, causes to be used, or accesses a computer, computer service,
or computer network without authorization.
Unauthorized use of a computer is a class A misdemeanor.

That is the Least violation - you are using a computer service!
That is just one example. So to all you who think it is no big deal. Just check the list, it is illegal in EVERY STATE!

Will you get caught?
Better ask if you can afford the legal fees!

legal or not is not the question.

yes persons have been prosecuted for doing so.
yes Windows is so dumb that it can actually connect to other wireless access points without you even noticing it if your not careful (how can you blame the user for that?!).

the question is, do you really want to do so? You tell me, 'without the other person knowing'. Are you sure that person does not know?

People who don't lock their wireless access might actually be *smarter* than you think - that's what we call *honeypots*.

Basically they might be inviting you to use their wireless access so that they can spy on your unencrypted Internet communications! and maybe access your own computer if you're not careful.

Yes, it is illegal. Even if they left their front door open, you wouldn't have the right to walk in and take their property, would you? And the fact that they're paying for their Internet access makes any access you would be stealing worth money, so it's not as if you're taking something that's free.

Don't do it. Don't even think about it.

Is it illegal to walk into someones house if their door is unlocked? Basically if you use another person's wireless network without their knowledge it is stealing. You have to ask yourself, is stealing wrong?

But it is also their own fault for not securing their network.
