Depends on if the person blackmailed can prove the money is his.

The answer isn't a direct yes or no!!! How much money is involved can you prove its yours and that you were blackmailed! Once the police are involved that means arrest and court! Once this happens the money can become evidence which you won't get back till after the trial and appeals etc and could take years. Now if its under $1000 dollars such as $999.99 the person will only go to local DJ and get some fines and probation so you will get your money right back! Now we come into the part of why were you blackmailed and will what you did put you in trouble as far as breaking a law?

If the person has legal proof of ownership, and the money was not obtained through illegal actions. They will get this money back after the person has gone through our legal system and is is not being used as evidence.
