While it is true that you may need a court order to make this officially official, you may want to simply stop listing it on his school records, etc. While you couldn't change his name from, say, John to Jack without difficulty, my sense is that Jr., Sr., etc. may not pose such a problem.

My brother was named Jr. at birth; my father died when he was a small child. He no longer uses Jr., and none of his credit cards, car title, school records, etc. indicate that he's Jr. I suspect it might "fall off" - and if it doesn't, there's no limit on when you apply for a name change.

You must contact your individual state to insure the proper procedure to complete a name change for a minor. Most of the time you must petition the courts to allow. I do agree with your reasoning to change the name and he should only be strictly a III. As long as you follow your states procedures, this should be granted based on the reasoning as the courts must research the reasoning before it is granted. It can be costly and time consuming as there are many questions your must answer. The only time that it is not granted is when someone will want to use a new name to avoid creditors, complete and illegal act, etc. Your reasoning should be a cinch to move through the courts.

stop using it and it's legal after a time. he should just be the III (third) without any jr.
