my grandmother died 10 moths ago....R.I.P. we took her to the hospital to get a hernia removed..we signed papers of how they were going to cut open the area of the hernia...but instead they did it the opposite way..then said that they had found a cancer tummor??? anyways...they said that they coudln't completet the opperation because of that...why would they tell us that they are going to cut open vertically and cut it horizontally...or viceversive... then they kept her in the hospital for 2 months for no reason they gave her so much morphene over a that period that she could hardly stay awake..and she forgot how to move her feet to walk and one of the nurses asked us if she was able to walk before..(yes she walked well for her age).. we wre so fed up with their carpp they gave every single day we were there we decided to pull her out of the hospital ..and the main Doc was insisting on keeping her at the same hospital. now we have the exray and papers from day one till the end of

of her stay at that hospital!! when we took her to another hospital they were scared to even re-open the opperation area because they knew something was done wrong.. and waisted two weeks at that hospital..then we took her to a hospital in bleverly hills and they did a great job...giving her anitbiotics..and the doctor was dissapointed that we did take her into that hospital any sooner because she was on the tip of the line from staying alive.....so my question is .... can we sue the first hospital we took her to???? sorry this is too long for some to read

If they found an inoperable cancer, they did nothing wrong. Unfortunately, it seems in most cases that the open air on a cancerous growth that cannot be removed surgically causes it to start growing even faster. Whether the surgeon chose to make a vertical or horizontal incision would not have changed anything. Surgeons often make adjustments once the patient is actually on the table.
As far as morphine goes, they would not have given it to her unless she was in pain.
Antibiotics are for infection, they do not have any effect on cancer cells.
I am very sorry for your loss, but cancer is insidious, the death rate is relatively high, and many people do not know they have it until too much damage is done for recovery.
I believe your family should concentrate on healing together instead of looking for fault.

If you completely understand what heppens with elderly people, finding nasty cancer in someone you weren't expecting to, and knowing how to diagnose and treat her, then by all means.

But, you sound like you need a bit of a fresher-upper.

Planning for surgery and doing it are related, but that doesn't mean it's set in stone. When you go in there and something's amiss that is bad, you do things differently. Maybe odd vasculature, maybe they found the cancerous mass. Things can change.

If they found a nasty tumor, it could be bad to cut it there. they have no idea if it is a metastisis (which means that the seeder tumor would have gotten her later), or if they could seed her abdomen when they took it out. Some tumors are quite nasty.

Perhaps she asked for the pain meds. Maybe the surgery had complications. Medical practice isn't 100%, don't expect them to be perfect. You went in there knowing the risks.

Its people like you who are helping to destroy the health care system, I work in a hospital and know the procedures. If they had her in the hospital for 2months, it was for a good reason, hospitals would prefer to get patients in and out not have them stay there for 2 months, it takes up beds. If they found cancer then they have to stop because they dont know anything about it, many complications can happen if they touch it without first getting intel on it. I am sorry for your loss, but its life and it sucks sometimes but you have to get over it. Hospitals try to save people not kill them, thats bad for business

Yep, you did not give them consent to do it another way, so they were doing something they weren't allowed.

In court they may challenge you with "Assumed Consent" though, if you signed a paper stating yes you can cut her open, and they thought the other way would be better at time of surgery, then it would be assumed consent. They should have asked first, though.

Edit:If you do sue, sue the hospital, they have more money and might just pay you off to avoid a negative mark.

All of us have the right to complain, if you think that they did something wrong to your grandma, you can sue the doctor/hospital, medical malpractice is rampant nowadays. The best thing you can do is ask a lawyer.

Talk to a malpractice lawyer. Explain the story to him or her. If the lawyer thinks you have a case he will take your case and file the papers in court. You can sue anyone or anything...the problem is if the lawyers think they can win your case.
