Okay, what is the law on people traveling in the bed of a pick-up truck? More specifically San Antonio, if that makes any difference.

Texas State Law says:

V.T.C.A., Transportation Code 545.414. Riding in Open Beds; Offense

(a) A person commits an offense if the person operates an open-bed pickup truck or an open flatbed truck or draws an open flatbed trailer when a child younger than 18 years of age is occupying the bed of the truck or trailer.

(b) An offense under this section is a misdemeanor punishable by a fine of not less than $25 or more than $200.

(c) It is a defense to prosecution under this section that the person was:

(1) operating or towing the vehicle in a parade or in an emergency;

(2) operating the vehicle to transport farmworkers from one field to another field on a farm-to-market road, ranch-to-market road, or county road outside a municipality;

(3) operating the vehicle on a beach;

(4) operating a vehicle that is the only vehicle owned or operated by members of the household;

(5) or operating the vehicle in a hayride permitted by the governing body of or law enforcement agency of each county or municipality in which the hayride will occur.

(a) Compliance or noncompliance with Subsection (a) is not admissible evidence in a civil trial.

(b) In this section, "household" has the meaning assigned by Section 71.005, Family Code.

So it is legal as long as they are 18 and/or it is the only vehicle your household has.

It is illegal for anyone to ride in the bed of a pickup, if they're under the age of 18. However, like any law, there are exceptions, and instances when even children can legally ride in the back of a truck.
If the truck is the family's only form of transportation, children under 18 can ride in the back.
If you're transporting workers under the age of 18 to farming fields to work, persons under 18 can ride in the back.
Or if you're involved in a parade, children under 18 can ride in the back of a truck.
Or if it's an emergency situation, persons under the age of 18 can ride in the back of a truck.

But breaking the law is a class c misdemeanor with a $25-200 fine. Repeat offenses (3 or more of same charges) will enhance to a class b misdemeanor (up to 6 months in jail), then class A (up to 1 year in jail), then a state jail felony (6 months to 2 years in a state jail facility). Hopefully you learn your lesson before this though.

It is illegal to ride in the bed of a pickup truck in most states. There is a universal seat belt thing in place and the back of a truck does not have seat belts.

Its even legal in Massachuttes, as long as other seats are filled, and your riding back against the back of the cab.

You may still get a ticket, but take it to court and you win.
