17 years old across the USA. And going with an 18yr old doesn't cut it if you're only 16...

Sadly, the theaters don't really check... there are no actual FINES that I can locate for a theater that violates the MPAA ratings.

R must be 17 years or older - or the person younger than 17 must be accompanied by a parent or guardian - an adult (17 or older).

Below is a link to exactly what a "R" means to the Motion Picture Association of America when they rated the movie:

An R-rated motion picture, in the view of the Rating Board, contains some adult material. An R-rated motion picture may include adult themes, adult activity, hard language, intense or persistent violence, sexually-oriented nudity, drug abuse or other elements, so that parents are counseled to take this rating very seriously. Children under 17 are not allowed to attend R-rated motion pictures unaccompanied by a parent or adult guardian. Parents are strongly urged to find out more about R-rated motion pictures in determining their suitability for their children. Generally, it is not appropriate for parents to bring their young children with them to R-rated motion pictures.

I think as long as you're 18 he's allowed to go with you unless the movie is NC-17 which means you have to be 17 or older to watch the movie.

it doesnt matter aslong as your over 17 or atleast look 17 to get in.

aslong as hes with you hes good, but byhimself he would need to be 17 but if hes accompanied by an adult which is considered 17 and over hes good to get in.
