I am a commission salesman who receives a small Salary of $200 a week. My office says we now have to punch a time card because of the labor law is on the dealerships back. I find it offensive that Management does NOT have to punch a time card, they too have a salary plus commission. Is this just a plain ole LIE so they can keep tabs on whether we are late or not? Is this discrimination that Management does not have to punch in and out and we do? I am wondering because it seems to me like the salesmen are being picked on. Anyone???>

First poster> I am not hourly, I am $200 regardless of how many hours I work.

Second poster> I am offended that they are using the excuse that the labor office is making this mandatory when in fact they are lying, they just want to keep tabs. Because if the Labor offices require us to do it then they would require the management to do it too or else they are discriminating against a portion of the workers which I always believed to be discrimination. Am I wrong?

Sensible> I understand what you are saying but when they brought this on they said I quote " this is not to keep tabs on the employees but the Labor board demands it. This is a lie, therefore I believe it to be discrimination. Am I wrong?

Sensible> Management is no different as far as Labor board is concerned. I believe that the Labor board would be looking at all employees not just certain ones. Otherwise they are commiting discrimination. Does this make sense?

Time clocks are fair and are used as proof of an employee being on the job on time and on days required. management has perks. It is the same with seniority. You may think that management has the same salary base and commissions as you, but they ARE management and the owner can seperate the rules for them. You will find this situation wherever you go.

Okay, you asked, but you're not going to like it. Amazing to me what people find "offensive" these days. Why would a simple thing like punching a time card offend you? So what if management doesn't have to punch a card? They're management; you are not. What if it isn't fair? If all things were fair and equal, what would the ACLU do for a living? I suspect you are a really nice person who just has a burr under their blanket for some reason. That being the case, just get over yourself on this issue. It is, in fact, a non-issue. I have learned to pick my battles. This is nothing to take a stand over, and certainly nothing about which to get offended.

Are you paid on an hourly basis? Or do you have a set salary of $200 per week, regardless of the hours that you work.

Most Management positions are salaried.

People that are considered "salaried" (not being paid hourly) are not required to punch a clock. But if you are hourly, your employer can make you punch a time clock.

Yes I do believe that they are doing this to keep tabs on the employees.
