Ok, so today I went to pick my sister up from school. Well as I driving back to our house (we live less than a mile from the school) we see this cop sitting at a four way stop. Well my sister realizes she's not wearing her seat belt and decides to buckle up. As I'm driving I look in the rear view mirror and notice that he's right behind me. Then I see the lights flash, so I pull over. Now I wasn't speeding, talking on a cell phone, running stop signs or anything. Well he comes up to the window and says that he saw my sister not wearing her seatbelt!!! He asks for my license, and well, I didn't have it on me. I know stupid. Then I couldn't find proof of insurence anywhere. So anyway, I was sure I was gonna get a ticket and was totally ready to accept it. Then he decides to give my sister the citation and told her she'll have to appear before a judge in two months. Do you think this sounds completely unfair?

No, I think that the cop was ensuring that your sister never forgets her seatbelt again, an act that could save her life one day. She wasnt wearing her seatbelt, and she got busted for it, thats just the way it goes. If she got in an accident, she wouldnt have the opportunity to buckle up in the middle of it, like she did in this case. The cop was just doing his job, and protecting your sister.

No,your sister DIDN'T have her seat belt on until she saw the police,so why would it be unfair? You should just be glad that you didn't get sited for it as well and for driving without your license or proof of insurance. I'd say the cop gave YOU a huge break.

As others said it is totally fair. She was not wearing it and that's that. The simplist way to protect your life is to wear a seatbelt.
You are very lucky that you didn't get the tickets as you would have been the one in court. If you are a minor as well this could have seriously impacted you. The cop did you a favor.
Your sister is a minor I assume that is why she has to go to court.

Nope - happens all the time - and he could have gotten you for no proof of license and insurance. Most states let you mail your seat belt ticket in though. Oh ya, In New York State the driver gets the ticket for anyone under 18 years old that isn't wearing a seat belt.

Instead of complaining, you should be relieved. He could have given BOTH of you tickets! Maybe he felt that he did you both a favor...follow my thinking...you forgetting your licence & registration won't kill you, however, wearing your seatbelt can save your life. He let you slide! He's hoping that by giving your sis the summons, that she'll never go without buckling up again! I think he was a pretty cool officer, I hope you do too!

completely unfair. my insurance rates are too high already....it is the drivers responsibility to make sure all passengers are buckled up. YOU, also should have been ticketed. when you went to court you show your license and proof of insurance and get the charge dismissed. probably the seat belt too because you showed responsibility and actually showed up on time to court.. but luckily my insurance premium did not increase because some dumb teenager did not smash his car; another dumb teenager did not get her face smashed through a windshield and the first dumb teenager didn't have to go through counseling because he KILLED HIS SISTER!!!!!!!!!!!!

No license...no proof of insurance...you're lucky he let you drive away. Unfair? A law was broken, the perpetrator was cited. He could have ticketed you as well. Then you'd have to go to court and prove you had insurance. Many states charge you for court costs in such cases. You got off easy.

A lot depends upon the law in your state. In my state, a seat belt violation is a secondary one, and he would have to have probable cause of another violation to stop you. As to your sister getting the citation, that is fair, she is the one who didn't "buckle up."

I knew of a guy who became a paraplegic at the age of 16 for simply not wearing a seatbelt. Your sister deserved the ticket!!!

Not unfair but personally I thought we were fighting the Communists because we didn't want the government micromanaging our lives.
I'm sure you sister can just pay the fine and not have to go to court.
