I recently bought a laptop on ebay for $2,200. I paid through paypal and everything seemed to be fine. Then suddenly, for some reason, ebay cancel the auction for some reason. The seller said the only way for him to ship me the laptop is to claim a dispute through paypal and close it. And so I did. But I haven't heard back from him yet. If he ends up not following through what he said he was going to do, what can of legal action can I take? I have his information and home address. How much would legal fees cost me?

First, a dispute is only the first step in the process. The next step is to escalate the dispute to a claim. The way to do this is to log in to Paypal, and click on "Resolution Center".

I had this same type of problem 2 weeks ago, and the seller didn't ever respond to the claim. I called Paypal today (888-215-5506). They said they will take 24 hours to review all the information, but since the seller never responded, it will be resolved in my favor.

One note though: they will try to recover the money. If the seller closed their bank account, or credit card, it's much harder to get your money.

Get it escalated to a claim, then they have 10 days to respond, then you go from there.

If you filed a dispute with paypal you should have gotten your money back.

Paypal is pretty good in terms of trying to help people not get screwed.

If you paid paypal via credit card you can call your credit card and tell them you never received your merchandise and would like the charges reversed.

If you claimed a dispute, you should have gotten your money back. If you didn't he owes you a computer. I suggest you provide the documentation to your local law enforcement office. Most police agencies have (or have access to) an internet/computer crimes division... They will either pursue it, or if they don't have jurisdiction, they will tell you who to give the information to.

Don't delete any information from your computer about the transaction... printed information won't help them access the source of the auction... and EBay WILL help law enforcement.

Send first a demand letter for the delivery of the laptop or return of they money you paid. If this is ignored, file an action in court plus all the damages.

from now on, if you insist on buying on ebay, ALWAYS pay through PAYPAL and fund it with a CREDIT CARD.

then if anything goes wrong and PAYPAL can't get you a refund, you then have the option of filing for a CHARGEBACK through your CC provider.
